TERMS AND CONDITIONS
These Terms and Conditions govern all sales of goods by TINDAL WINE MERCHANTS LTD (‘The Vendor’). By placing an order, the Buyer accepts these Terms and Conditions.
PRICES
All orders are subject to stock availability, and prices may change without prior notice.
VAT
Prices listed are exclusive of VAT, currently set at 23%.
CREDIT ACCOUNTS
Requests for a Credit Account must be submitted using the provided Application Form along with the Direct Debit Mandate. Overdue accounts will incur interest at a rate of 3% per annum above the interbank rate.
TITLE
The Vendor retains ownership of all goods supplied until payment is received in full for all sums due. In the event of non-payment by the due date, the Vendor reserves the right to enter any premises where the goods are located and repossess them. The risk of loss or damage to the goods passes to the Buyer upon delivery.
CLAIMS
Claims for shortages, pilferage, breakage, and non-delivery must be reported to the carrier and the company within two days of receipt or three days from dispatch. Defective goods must be retained for inspection.
NATIONWIDE DELIVERIES
Free delivery will be provided for orders of a minimum of five cases.
TINDAL WINE MERCHANTS Ltd MARKETING & ADVERTISING POLICY
- Purpose
This policy sets out the standards for responsible, lawful and ethical marketing and advertising of wine and related products in Ireland. Our objective is to promote our products in a manner that reflects our commitment to responsible alcohol consumption, consumer protection, and ethical business practices.
- Scope
This policy applies to all marketing and advertising activities undertaken by or on behalf of the business, including:
- Digital marketing (website, email, social media, online advertising)
- Print and outdoor advertising
- In-store promotions and point-of-sale materials
- Events, tastings, sponsorships, and partnerships
- Influencer and third-party promotional activity
- Legal and Regulatory Compliance
All marketing and advertising must comply with applicable Irish laws, regulations, and industry codes, including but not limited to:
- The Public Health (Alcohol) Act 2018
- The Intoxicating Liquor Acts
- The ASAI Code of Standards for Advertising and Marketing Communications
- Data protection obligations under GDPR
In particular:
- Alcohol advertising must not be targeted at, or be likely to appeal to, persons under 18 years of age.
- Age restrictions must be clearly communicated where required.
- Mandatory health warnings must be displayed where applicable.
- Responsible Representation of Alcohol
- Marketing must not encourage excessive, unsafe, or irresponsible consumption of alcohol.
- Wine must not be presented as enhancing physical performance, mental health, sexual success, social status, or personal achievement.
- Alcohol must not be portrayed as a solution to personal, social, or emotional problems.
- Messaging should focus on quality, craftsmanship, provenance, food pairing, and moderate enjoyment.
- Accuracy and Transparency
- All claims relating to price, origin, vintage, tasting notes, availability and awards must be truthful, accurate and capable of substantiation.
- Promotions must clearly state any terms, conditions, or limitations.
- Paid partnerships, sponsorships and gifted products must be clearly disclosed in line with ASAI guidance.
- Ethical Marketing Practices
Ethical customer engagement is central to our marketing approach:
- We will not use misleading, manipulative, or high-pressure sales tactics, including false urgency or artificial scarcity.
- Customer data will be collected and used responsibly, transparently, and in accordance with GDPR.
- Cultural references and wine-producing regions will be represented respectfully and accurately.
- Marketing content will be inclusive and non-discriminatory in language, imagery, and tone.
- Social Media and Digital Marketing
- Content must not use language, humour, imagery, or formats that primarily appeal to minors.
- User-generated content that promotes irresponsible consumption may be removed or moderated.
- Influencers and partners must comply with Irish alcohol advertising regulations and this policy.
- Monitoring and Accountability
Marketing activity may be reviewed internally to ensure compliance. Any concerns regarding legal or ethical standards must be reported to management and addressed promptly.
